Archive Rules

The archive rules are established by the Federal Archive Act (BGBl. 162/1999), Museum Regulations for Kunsthistorisches Museum, Museum für Völkerkunde and Österreichisches Theatermuseum (BGBl. 395/2009), Decree on Records not of Archival Relevance (BGBl. 366/2002), Decree on Federal Records (BGBl. 367/2002), Data Protection Act (BGBl. 165/1999), and the amended Copyright Act (BGBl. 32/2003). 

Definitions

  1. Kunsthistorisches Museum Wien, a scientific institution under public law, Burgring 5, 1010 Vienna, is vested with responsibility in accordance with Section 3, Para. 2 and Para. 3 of the Federal Archive Act (BGBl. 162/1999) and Section 2 of the Decree on Records not of Archival Relevance (BGBl. 366/2002) for maintaining its records
  2. The maintenance of records is the responsibility of the museum archive under Section 17 of the Museum Regulations for Kunsthistorisches Museum, Museum für Völkerkunde and Österreichisches Theatermuseum (BGBl. 395/2009), and Section 2, Para. 6 and Para. 7 of the Federal Archive Act (BGBl. 162/1999).
     
    1. The museum archive is designated an archive of the federal government, Federal Archive Act (BGBl. 162/1999) Section 2, Para. 7.
    2. The museum archive is endowed with the status of a museum collection pursuant to Section 17, Para. 1 of the Museum Regulations for Kunsthistorisches Museum, Museum für Völkerkunde and Österreichisches Theatermuseum (BGBl. 395/2009).
    3. The archival material is designated a protected landmark by Section 17, Para. 2 of the Museum Regulations for Kunsthistorisches Museum, Museum für Völkerkunde and Österreichisches Theatermuseum (BGBl. 395/2009).
  3. The records of Kunsthistorisches Museum have the status of an archive of the federal government under the Federal Archive Act, Section 2, Para. 4 c (BGBl. 162/1999).
  4. The definition of records is governed by Federal Archive Act, Section 2, Para. 2 (BGBl. 162/1999).

Field of activity and authority

  1. Within the meaning of Federal Archive Act, Section 2, Para. 5 (BGBl. 162/1999) the museum archive has responsibility for archiving the records of collections and departments of Kunsthistorisches Museum.
  2. The collections and departments of Kunsthistorisches Museum are required to select from the records accumulated in the course of their activities, or in connection with legal acts, those no longer required for their current work, and to make these available to the museum archive together with auxiliary material (e.g. registers) that may be necessary for their use.
  3. These records are to be made available no later than 30 years following the closing date defined by the Federal Archive Act, Section 5, Para. 2 (BGBl. 162/1999) in conjunction with Data Protection Act, Section 1, Para. 3.
  4. In appraising the archival relevance of records under the Federal Archive Act, Section 2, Para. 3 (BGBl. 162/1999), the Decree on Records not of Archival Relevance, (BGBl. 366/2002), and Decree on Federal Records (BGBl. 367/2002) are to be applied.
  5. Under the Federal Archive Act (BGBl. 162/1999) Section 3 Para. 7 records not of importance for historical preservation are to be destroyed.
  6. The director of the museum archive is editor of the Jahrbuch des Kunsthistorischen Museums Wien.
  7. The director of the museum archive is responsible for provenance questions for Kunsthistorisches Museum Wien.
  8. Provenance research for Kunsthistorisches Museum Wien has been carried out since 1933 by a member of the Commission for Provenance Research.
     
    1. Responsible for scholarly aspects are Dr Pia Schölnberger (Federal Ministry for Arts, Culture, the Civil Service ans Sport) and Professor Dr Birgit Kirchmayr.
    2. For administrative purposes provenance research is subject to the office of the Director General of Kunsthistorisches Museum Wien.
    3. The office is located in the museum archive.
  9. One sample of all printed forms issued by Kunsthistorisches Museum Wien is to be deposited in the museum archive for conservation.
  10. The museum archive is authorised to preserve at its own discretion records beyond those defined in Point 4 above, for the purposes of historical documentation.

Information and use

  1. The museum archive is subject to disclosure obligations under Federal Archive Act (BGBl. 162/1999), Section 7, Para. 1 while maintaining statutory protection periods in the public interest as established by Section 7, Para. 3 of the act.
  2. isclosure obligations may also be met by permitting access to archival material under the Regulations for Use of the Museum Archive.
  3. Pursuant to Federal Archive Act (162/1999), Section 8, any person may make use of released archival material for official, scholarly, and journalistic purposes.

Terms of protection

  1. The release of archival material for public use is subject to Federal Archive Act (BGBl. 162/1999), Section 8, the Data Protection Act (BGBl. 165/1999), and amended Copyright Act (BGBl. 32/2003).
